Welcome to Darlingg. These Terms & Conditions ("Terms") govern your use of darlingg.com (the "Site") and your purchase of products from us. The Site and the Darlingg brand are owned and operated by Infinity Marketing, a sole proprietorship with its registered office at Vegas mall office building 2nd floor ("Darlingg", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to purchase from the Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

2. Products & Pricing

  • All prices are listed in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise.

  • Product images are for representation. While we work hard to display colours and finishes accurately, slight variations may occur due to screen settings and photography.

  • We reserve the right to modify prices, discontinue products, or correct pricing/description errors at any time. If an order is placed at a materially incorrect price due to a technical or typographical error, we may cancel it with a full refund.

  • Products are intended for personal use only. Bulk purchases for resale are not permitted without our prior written consent, and we may cancel orders we reasonably believe are for unauthorized resale.

3. Orders & Payment

  • An order is confirmed only when you receive an order confirmation from us. We reserve the right to refuse or cancel any order (e.g., suspected fraud, product unavailability, pricing errors); prepaid amounts for cancelled orders are refunded in full.

  • Payments are processed securely through Razorpay, our payment gateway partner. Cash on Delivery, where offered, is subject to the limits and terms in our Shipping Policy, including OTP-verified handover.

  • You agree to provide accurate, complete billing and shipping information. Losses arising from incorrect details provided by you are handled as set out in the Shipping Policy.

4. Shipping & Delivery

Shipping timelines, charges, serviceability, COD limits, delivery attempts, and reverse pickup are governed by our Shipping Policy, which forms part of these Terms. In summary: dispatch within 24–48 hours (Sun–Mon), delivery in 2–4 business days to metros and 4–7 business days across the rest of India via Shadowfax

5. Returns, Refunds & Warranty

Returns, replacements, refunds, and the Breeze Fan 6-month limited warranty are governed by our Refund & Return Policy, which forms part of these Terms. In summary: eligible products — Breeze Fans, phone charms, phone cases, and gems — may be returned within 7 days of delivery for any reason, with free doorstep reverse pickup via Shadowfax, and approved refunds are processed to your original payment method within 7–8 business days.

6. Offers, Discounts & the 11:11 Event

  • Promotional offers, including our monthly 11:11 event, are valid only for the stated duration and on eligible products.

  • The 11:11 offer runs on the 11th of each month from 11:11 PM to 11:22 PM IST. The discount code is valid only within this window, and orders must be successfully paid before 11:22 PM IST to qualify. Adding items to cart does not reserve the discount.

  • Discount codes are limited to one use per customer per event, cannot be combined with other offers or codes, and hold no cash value.

  • We reserve the right to modify, suspend, or discontinue any offer at our discretion, and to cancel orders that abuse promotional terms (including orders placed through multiple accounts to bypass usage limits).

7. Warranty Disclaimer

Except for the express Breeze Fan warranty described in our Refund & Return Policy, products are provided without additional warranties beyond those that cannot be excluded under the Consumer Protection Act, 2019 and other applicable law. Nothing in these Terms limits your statutory rights as a consumer.

8. Intellectual Property

All content on the Site — including the Darlingg name, logo, product designs, images, text, and graphics — is owned by or licensed to Infinity Marketing and protected under applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without written permission.

9. User Conduct & UGC

  • You agree not to misuse the Site, attempt unauthorized access, scrape data, place fraudulent orders, or interfere with its operation.

  • If you participate in our UGC/rewards program or tag us in content (e.g., on Instagram @supdarlingg), you grant Darlingg a non-exclusive, royalty-free licence to repost and use that content on our Site and social channels with credit. If you'd like your content removed, email us and we'll take it down within a reasonable time.

  • Reviews must reflect genuine experiences. We may remove content that is fake, abusive, or unlawful.

10. Limitation of Liability

To the maximum extent permitted by law, Darlingg's total liability for any claim arising from an order shall not exceed the amount paid by you for that order. We are not liable for indirect or consequential losses, or for delays and failures caused by events beyond our reasonable control (including courier disruptions, strikes, natural events, or government actions). Nothing in this clause excludes liability that cannot be excluded under Indian consumer law.

11. Indemnity

You agree to indemnify Darlingg against claims arising from your breach of these Terms or misuse of the Site.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer protection law, courts at Delhi shall have exclusive jurisdiction over disputes arising from these Terms.

13. Grievance Redressal & Customer Support

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:

14. Changes to These Terms

We may update these Terms from time to time; the latest version will always be available on this page with the updated date. Continued use of the Site after changes constitutes acceptance.
